Terri J Photography Client Agreement
By electronically agreeing to the below terms, clients are legally bound to this contract.
BETWEEN:
Terri J Photography (referred to hereafter as “Photographer”)
AND:
The Client whose name is indicated in the form below
PHOTOGRAPHY: This contract is an agreement for pet and/or family photography. It covers digital photos, proofs, prints, or albums. It represents the full agreement between the Client and the Photographer.
PHOTOGRAPHY SESSION: Client is guaranteed a minimum of 20 minutes of shoot time for a photography session of up to two dogs and two family members. Additional pets or family members may require additional time and fees. Additional fees will be discussed and agreed upon prior to the photo session.
PHOTOGRAPHY FEES: Photography session fees of CAD100.00, payable by e-transfer, and a signed copy of this agreement are required to reserve a photography session.
RESPONSIBILITY FOR PET: The Client represents that his/her pet has not bitten or shown any aggressive or threatening behaviour toward any person, child or animal. The Client understands that he/she is-solely responsible for any harm caused by his/her pet, to any person, other pets, or property, while the Client's pet is at the shoot.
LIMIT OF LIABILITY: We take the utmost care with respect to the exposure, retouching, and transportation of digital captures, proofs and prints. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Photographer’s control, Photographer’s liability is limited to either a reshoot to be scheduled at no additional cost or a refund of 50% of the session cost plus any other payments received. In the unlikely event that Photographer is injured or becomes too ill to attend the photography session, Photographer will make every effort to reschedule to the earliest possible date.
DISPLAY PROMOTION: It is agreed that the Photographer may display and use photographs from the session for advertising, display, website and Internet promotion such as Instagram or Facebook, photographic contests or shows.
PET MODEL RELEASE: The Client hereby grants to the Photographer the irrevocable and unrestricted right to use and publish photographs of the Client's pet or in which the Client's pet may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Client hereby releases Photographer and its legal representatives and assigns from all claims and liability relating to said photographs.
CLIENT MODEL RELEASE: The Client gives the Photographer permission to use and share photographs of them or their family, including altering and copyrighting them, for self-promotion, publicity, publishing, contests, or gallery shows. The Photographer agrees not to use the images in any way that could be harmful or disrespectful to the Client or anyone in the photos
CANCELLATION/NO SHOWS: Client understands that by entering into this agreement, Photographer is foregoing other photographic opportunities. In the event of a cancellation or no show by Client, the fees paid are non-refundable. Fees are transferable as a deposit on a full Session or a specially agreed upon mini session if a date change is necessary, provided forty-eight hours notice of postponements or cancellations is provided.
WEATHER: If, in the opinion of the Photographer, inclement weather or other adverse conditions prevent the creation of photographs meeting the artistic standards of Terri J Photography, the Photographer may elect to use an alternate location or to reschedule the session. Photographer will reschedule at the earliest date possible, with no additional charge.
COOPERATION: Photographer is not responsible if Client and/or pets fail to cooperate during photography sessions, or for missed images due to details not revealed to Photographer.
COPYRIGHTS: The photographs produced by Photographer are protected by Copyright Law (all rights reserved) and may not be reproduced in any manner, (including by screenshots), or altered in any manner (including but not limited to applying filters, cropping, removing or adding objects or persons) without Photographer's explicit written permission. If purchased, the digital images are the property of Client for personal use and for the purposes of the reproduction and giving of photographs to friends and relatives.
SESSION PROOFS: Client will receive an on-line proof gallery of low-resolution, watermarked images within 3 weeks of their session (unless otherwise agreed upon). Images are edited at the photographer's discretion, and delivered proofs may not include all images shot. The photographer reserves the creative right to edit and release only those deemed creditable as professional in quality and within the photographer's artistic standards.
DIGITAL COPY OF ORIGINALS: A digital copy of all proofs purchased at full resolution will be made available for purchase, complete with copyright release for personal use. Client accepts all responsibility for archiving and protecting the photographs. Photographer does not commit to permanently archiving the image files. Photographer is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read images provided. It is Client's responsibility to make sure that digital files are copied to new media as required.
IMAGE PROCESSING/PRINTING: Unless agreed upon prior to any editing work, proof sets may contain a mixture of colour and black and white images. Limited colour correction and/or retouching are included at Photographer's discretion. Any requests above what is presented in the online viewing gallery will be billed at $50/hour, one hour being minimum and required. This may include retouching such as extensive blemish or scar removal, head swapping, body-slimming, etc.
Photographer is not responsible for any prints that are not ordered directly. For best results, clients purchasing the high-resolution digital files should order their prints through Photographer or a reputable lab.
PRINT LIFE: Client is aware that colour dyes and inks in prints may fade or discolour over time due to the inherent qualities of dyes and inks, and Client releases Photographer from any liability for claims whatsoever based upon the fading or discolouration due to the inherent qualities.
ENTIRE AGREEMENT: This agreement contains the entire understanding between Photographer and Client. If the parties decide to waive one provision of this agreement, it does not mean that any other provision is also waived.
